النظام العام الاجتماعي بين الحماية الاجتماعية للعامل وتداعيات العولمة الاقتصادية

الملخص
:ملخص يعد النظام العام الاجتماعي بمثابة المنهج الحمائي للعمال داخل علاقات العمل، وفقا لنصوصه القانونية آمرة توفر حد أدنى من الحماية للعامل باعتباره طرفا مذعنا في عقد العمل، عن طريق سن قواعد تعيد التوازن العقدي لهذه العلاقات، إذ لا يمكن الخروج عليها إلا إذا كانت تقدم للعامل امتيازات أفضل من تلك الممنوحة له بموجب القانون و بالاتفاقيات الجماعية، ومما لاشك فيه أن العولمة الاقتصادية زعزعت النظام العام الاجتماعي وأثرت على سوق العمل على حد سواء فجعلته أكثر مرونة فاسترجع المستخدم من خلالها بعضا من الحرية في تنظيم علاقة العمل أدى إلى قضم تدريجي للحقوق المكتسبة و تقليص في حجم دائرة الحماية الاجتماعية التي تضمنها أحكام النظام العام الاجتماعي، كما يظهر تأثيرها أيضا من خلال أشكال المستحدثة في التشغيل و على ظروف العمل على حد سواء، التي صنفت على أنها من العمل الهش، هذا ما جعل الفقه يدق ناقوس الخطر حول مستقبل قانون العمل و الحماية الاجتماعية في ظل الهيمنة المتنامية للعولمة الاقتصادية والبحث عن سبل لترشيدها Abstract Social public order is considered to be the protective approach of workers in labor relations, in accordance with peremptory legal provisions that provide a minimum level of protection to the worker as a party of the labor contract by enacting rules that restore the contractual balance of such relations where it is not possible to bypass them, unless, it provides the worker with conditions better than those granted by law and collective agreements. Undoubtedly, economic globalization has shaken the social public order and affected the labor market alike, making it more flexible. Through it, the user regained some freedom in organizing the work relationship, which led to a gradual nibbling of the acquired rights and a reduction in the social protection circle size that is included in the social public system provisions , as its effect also appears through the forms developed in employment and on working conditions alike, which Classified as fragile work, this is what made jurisprudence sound the alarm about the future of labor law and social protection in light of the growing dominance of economic globalization and the search for the ways that lead to rationalize it.
