جريمة التفليس المرتكبة من قبل مديري الشركات

الملخص
شهدت الشركات انتشارا واسعا في الجزائر منذ بداية الثمانينات، بحث مرت بمرحلة انتقالية هامة، من الاقتصاد الموجه إلى اقتصاد السوق، الذي يعتمد على تنمية روح المبادرة لدى الأفراد والجماعات، وقد بدت بوادر التطور تظهر على الجانب الاقتصادي للدولة خلال هذه المرحلة، إلا أن هذه الشركات بالرغم من القفزة التي حققتها للدولة إلا أنها لم تسلم من الجرائم التي تسعى إلى هدم كيانها وانتهاك أموالها، وقد صنف هذا النوع من الجرائم ضمن ما يسمى بالجرائم الاقتصادية، والتي كان عالم الاقتصاد بيئة خاصة لظهورها ونموها فيه، ومن أبرز وأخطر الجرائم التي مست بالشركات هي جريمة التفليس، ذلك أن مرتكبها وركنها المفترض هو مدير هذه الشركة والذي من المفترض أن تكون المصلحة التي يحميها هي مصلحة الشركة بالدرجة الأولى، إلا أنه يقوم بالعكس، من أجل هذا كان لا بد من دراسة هذه الجريمة عن قرب من جانبها الموضوعي لكي يتم إيجاد سبل لمكافحتها. Abstract : Many companies attested a wide spread in Algeria from the eighties, that passed an interesting transitional phase from an oriented economy to the Market economy, that relies on growing entrepreneurial spirit for both, persons and groups. In this respect, it started the appearance of the development precursors in the economic part to the country during this period. However, this companies despite its crucial jump that gave the help to the country. Otherwise, it is undelivered from the crime that is try to destroy it’s existenceand violates it’s money. These kind of crime is classified among the economic crime, where the economic world was a specific environment for its appearance and growth. The bankruptcy crime is the major and the dangerous crime that touched the companies. Where it’s committed who suppose to be its manager and who suppose too to protect its interest in the first grade, he do the contrast. In this regard, it is inevitable to study this crime closely to its objective side for the sake of finding up a preventative ways forward, because this crime do not touch only the company alone, instead the country as a whole.
