الملخص

الملخص: تطورت التكنولوجيا ووسائل الاتصال ومن أبرزها الإنترنت بشكل كبير وسريع، أدى إلى إلغاء الحدود الجغرافية بين الدول، وهذه الوسيلة أثرت على جميع المجالات الاجتماعية والإنسانية بما فيها الأحوال الشخصية، فكان للأحوال الشخصية نصيب من وسائل الاتصالات الحديثة فأصبح من الممكن إبرام عقود الزواج عن طريق شبكة الإنترنت، والتعبير عن الإرادة في ظل العقود الإلكترونية يتم بالتقاء طرفي العقد من خلال برنامج معالجة معلومات عبر شبكة الإنترنت. وتبرز أهمية هذا الموضوع فيما تمثله هذه التقنيات الحديثة في حياة الأفراد سواء المهنية أو الشخصية، وتكمن أهميته كذلك في أنه يجب توضيح حكم إبرام عقد الزواج عبر شبكة الإنترنت، وذلك بسبب وجود فراغ تشريعي بشأن هذا الموضوع؛ فكان لابد من تحديد طبيعة مجلس عقد الإلكتروني، ودراسة حكم إبرام عقود الزواج عبر شبكة الإنترنت سواء عن طريق الكتابة أو المحادثة. الكلمات المفتاحية: عقد الزواج- الإنترنت- مجلس العقد.
