قاعدة الضرورات تبيح المحظورات وتطبيقاتها الفقهية

الملخص
يهدف البحث إلى بيان معنى الضرورة، ومن ثم تحديد نوع الضرورة التي تجيز أو تبيح فعل المحظور، وقد تبين من خلال الكلام عن القاعدة أهم التقييدات التي تطرأ عليها، بل من المعلوم أن القاعدة لا يعمل بها على أطلاقها ونما تقدر بقدرها من غير إلحاق ضرر بالغير من الناحية المدنية، واستطيع القول بأن المقصد الأسمى من البحث هو بيان سماحة الإسلام ومراعاة الظروف الطارئة وتمييزها عن الظروف الاعتيادية من باب اليسر ورفع الحرج ولكن ضمن ضوابط وقواعد لا تتجاوز الأصول الفقهية التي اعتمد عليها الفقهاء من غير تفريط، مع مراعاة الأعراف الصحيحة التي لم تخالف نصاً من نصوص الشريعة.The aim of this research is to clarify the meaning of necessity and then determine the type of necessity that permits or allow the prohibited act. It was revealed through the speech about the rule of the most important restrictions that occur on it, but it is known that the rule does not work to launch it, while it is valued with its esteem without causing harm to others in the civil aspect, I can say that the supreme intention of the research is to clarify the tolerance of Islam and to observe emergency circumstances and distinguish it from the usual conditions as a matter of ease and lift the embarrassment, but within regulations and rules that do not exceed the jurisprudential principles in which the jurists relied on and without over plus, but with taking into consideration the correct norms that did not violate a text of the Sharia texts.
