حركة إصلاح السجون في عهد عمر بن عبد العزيز رضي الله عنه ومكانتها في الفقه الإسلامي

الملخص
الملخص: يهدف البحث إلى إبراز الوثائق الأولى لحقوق السجناء ومعاملتهم في الإسلام، من خلال الحديث عن إصلاح السجون ومعاملة السجناء التي حدثت في عهد الخليفة الأموي الراشد عمر ابن عبد العزيز، ثم بيان مكانة هذه الوصايا في الفقه الإسلامي، وقد تبين: أن هذه الوصايا، تعد أول قانون يرعى حقوق السجناء، ولقد اهتم بها الفقهاء، وأكثر ما لوحظ ذلك عند الإمام أبي بوسف من الحنفية؛ إذ شرحها في كتابه الخراج، فكان الشرح بمثابة المذكرة التوضيحية لهذا القانون، وقد اعتنت هذه الوثائق في التأكيد على ضرورة تعجيل البت في قضايا السجناء، وتفقد السجون بوجه دوري، والإنفاق على السجناء ورعايتهم صحياً، والسماح بزيارتهم، والدعوة إلى تصنيفهم على أساس الجنس وأسباب الحبس، ومنعت في تأديبهم: حلق لحاهم، ووضع السلاسل في أعناقهم، ومنعهم من أداء صلاتهم بحرية، وهذا يؤكد سبق المسلمين في حركة إصلاح السجون الداعية إلى رفع الظلم عن السجناء وتحقيق الغايات التي وضعت من أجلها عقوبة الحبس. Abstract: This research aims to highlight the first documents of the rights of prisoners and their treatment in Islam, by talking about the prison reform movement and the treatment of prisoners that took place during the reign of the Umayyad Caliph Al-Rashid Omar bin Abdul Aziz, then clarifying the status of these wills in Islamic jurisprudence. We can say that these commandments are considered The first law that takes care of the rights of prisoners, and jurists have cared about it, and most of that was observed by Imam Abi Yosef from the Hanafi, as he explained it in his book Al-Kharaj. So the explanation was like an explanatory memo to this law, and these documents took care of emphasizing: The need to expedite the settlement of prisoners ’cases. Spending on no Prisoners and their health care. Allowing them to visit, and calling for their classification on the basis of sex and the reasons for incarceration. Prohibited in disciplining them: shaving their beards, putting chains in their necks. or preventing them from performing their prayers freely. For all of these we can say : Islam confirms the precedence of Muslims in the prison reform movement calling for the removal of injustice from prisoners and the achievement of The goals for which the imprisonment penalty was.
