اثبات التعاقد عبر تقنية البلوك تشين.

الملخص
المستخلص تعد تقنية البلوك تشين منظومة تكنولوجية تسمح بالتعاملات الرقمية الموثوقة بين طرفين أو أكثر، وهذه المعاملات مصدقة من جهة أطراف أخرى ومن هنا تأتى أهميتها الأمنية والتوفيقية ، وهى تعمل على الغاء ما يسمى بالمركزية ، الامر الذى يتيح للمتعاملين من خلالها انجاز أى معاملات بشكل مباشر دون وجود لطرف ثالث . وتتيح هذه التقنية لكل طرف تتبع المعلومات عبر الشبكة المغلقة والأمنة باستخدام رموز رقمية تمثل الأصول والقيمة ، وتمثل كل معاملة او تعاقد كتلة او بلوك تحتوى على معلومات ، وترتبط هذه الكتل او البلوكات مع بعضها فى سلسلة تسمى سلسلة الكتل المتتالية ، ولا يمكن لا ى طرف تعديل البيانات والمعلومات الموجودة بكل بلك . وتعد الامارات أول دولة عربية تبادر باستخدام تكنولوجيا البلوك تشين ، فقامت مؤسسة دبى للمستقبل بإنشاء المجلس العالمى للتعاملات الرقمية في فبراير 2016 ويضم هذا المجلس أكثر من 47 جهة متخصصة سواء كانت شركات أو حكومات ليكون مرجعية وبيت خبرة للجهات التى تستخدم تقنية البلوك تشين او الجهات الأخرى ، كما أطلقت استراتيجية دبى للتعاملات الرقمية في اكتوبر 2016 عن استخدام تقنية البلوك تشين في تعاملات حكومة دبى المالية ، والتحول بشكل كامل في 2020 الى تعاملات البلوك تشين . , وقد حاولت اعداد هذا البحث بعنوان " إثبات التعاقد عبر تقنية البلوك تشين " حيث تناولته من خلال مبحثين في الاول أوضحت ماهية تقنية البلوك تشين والعقود الذكية ، أما في الثانى فتناولت فيه طرق اثبات العقود الذكية ، خاصة وأنه لا يزال إنشاء الإطار القانوني للعملات المشفرة قيد التنفيذ ، ونأمل أن يكون هذا البحث أمام المجلس العالمى للتعاملات الرقمية بدبى عند وضع الأسس واللوائح القانونية والتشريعية لتقنية البلوك تشين في المستقبل . الكلمات الدالة : البلوك تشين ، العقود الذكية ، الكتابة الالكترونية ، التوقيع الالكترونى ، الايثيريوم . Abstract Blockchain technology is atechnological system that allows reliable digital transactions between two or more parties, and these transactions are certified by other parties, hence its security and compromise importance, and it works to cancel the so-called centralization, which allows customers to complete any transactions directly without the presence of To a third party. This technology allows each party to track information via the closed and secure network using numerical codes representing the assets and value, and each transaction or contract represents a block or blocks containing information, and these blocks or blocks are connected to each other in a chain called the series of successive blocks, and no party can modify The data and information in all of them. The UAE is the first Arab country to initiate the use of blockchain technology. Dubai Foundation for the Future established the World Council for Digital Transactions in February 2016 and this council includes more than 47 specialized agencies, whether companies or governments, to be a reference and an expert house for entities that use blockchain technology or other entities, Dubai’s digital transaction strategy was launched in October 2016, using blockchain technology in the Dubai government’s financial dealings, and fully switching in 2020 to blockchain transactions. I tried to prepare this research with the title "Proofing the contract via blockchain technology", where I dealt with it through two studies in the first that clarified what is blockchain technology and smart contracts, while in the second, I dealt with ways to prove smart contracts, especially as the legal framework for cryptocurrencies is still being implemented. We hope this research will be before the Dubai World Council for Digital Transactions when laying the foundations and legal and legislative regulations for blockchain technology in the future.
