الملخص: لقد ساهم أعضاء المجتمع الدولي في إقرار قواعد حماية البيئة البحرية ضمن مجموع قواعد قانون البحار الذي صاغها في اتفاقية مونتيغوباي لقانون البحار 1982م، والتي جاءت كنتيجة للحد من أخطار التلوث في سبيل توفير الحماية الشاملة للبيئة عمادها مبدأ الالتزام العام بحماية البيئة البحرية. انطلاقا من هذا المبدأ بدأت تتفرع منه مختلف القواعد القانونية الهادفة إلى حماية البيئة البحرية من التلوث، وترتبت عنه أثار قانونية ناتجة عن هذا الالتزام العام بتحديد اختصاصات الدول بين دولة العلم والدولة الساحلية ودولة الميناء، كما تم كذلك وضع قواعد جديدة تقوم على أساس التعاون و التضامن الدولي لتمكين الدول من مواجهة التلوث البحري الذي يهدد سواحلها بل يهدد كامل البيئة البحرية. Résumé Les membres de la communauté internationale ont contribué a l'adoption des règles de protection de l'environnement marin dans les règles du droit maritime formulés dans la convention de Montegobay relative au droit maritime de 1982, concernant la réduction des risques de pollution afin d'assurer une protection complète de l'environnement fondé sur le principe de l'obligation générale de protéger le milieu marin. Partant de ce principe, on a pu avoir plusieurs règles juridiques qui mènent a la protection de l'environnement marin contre la pollution, résultant de cette obligation générale pour déterminer les spécialités des pays, entre celle du drapeau, côtier et du port, ainsi que de nouvelles règles fondées sur la coopération et de la solidarité internationales pour permettre aux Etats de faire face a la pollution marine qui menace leurs cotes et menace même l'ensemble du milieu marin. Abstract The international community members have contributed in establishing the maritime environment protection rules within the set of the law of sea rules, which was drafted in Montego Bay convention on the law of the sea 1982. These rules was set to reduce the pollution dangers in order to offer a total protection for the environment, characterized by the principle of the general commitment to marine environment protection. Based on this principle, the different legal rules aiming to protect the maritime environment from pollution started to emerge and divaricated; thus, there appeared new legal effects resulting from this general commitment concerning the definition of the states specialities, between the flag states, coastal states and port states. Moreover, new rules was set based on the international cooperation and solidarity in order to enable the states to face the maritime pollution that threatens their costs, in fact, it does threaten the overall maritime environment.
