المجلس الدستوري الجزائري بين التبعية والاستقلالية على ضوء التعديل الدستوري 2016

الملخص
تعتبر الرقابة على دستورية القوانين من الركائز الأساسية لحماية مبدأ سمو الدستور، وتختلف آليات تحريك هذه الرقابة من دولة إلى أخرى بحسب نوع الرقابة المعتمدة في دستور الدولة بين الرقابة السياسية والرقابة القضائية. تتولى مهمة هذه الرقابة في الجزائر ووفقا للدستور الجزائري المجلس الدستوري وهو الهيئة التي تطرح اشكالية استقلاليتها وتبعيتها بالنظر للسلطة التنفيذية ، وان كان لهذا المجلس من اهمية في دراسة نظام الحكم عموما فهي من الاهمية بما كان في ظل الاوضاع التي تعيشها الجزائر و في هذه الفترة الخاصة بانتهاء العهدة والاقبال على انتخابات رئاسية. Résumé La control de la constitutionnalité des lois est l’un des principaux piliers de la protection du principe de la suprématie de la Constitution et des mécanismes permettant de transférer ce contrôle d’un pays à l’autre en fonction du type de contrôle adopté dans la Constitution de l’État entre contrôle politique et contrôle judiciaire. Selon la Constitution algérienne, la tâche de ce contrôle est assumée par le Conseil constitutionnel, un organe qui soulève le problème de son indépendance et de sa dépendance vis-à-vis du pouvoir exécutif. Abstract The control of the constitutionality of laws is one of the basic pillars of the protection of the principle of the supremacy of the Constitution. The mechanisms of moving this censorship differ from state to state according to the type of censorship adopted in the state constitution between political supervision and judicial supervision.
