مسالك المالكية في الجواب عن مشكلات المدوّنة

الملخص
ضمّت المدوّنة الكبرى التي رواها سحنون عن ابن القاسم عن مالك أقوال مالك، وأصحابه، وقد رجّح أهل العلم أقوال الأئمة فيها على أقوالهم في غيرها، إلا أنّهم لم يرتضوا ما جاء عنهم في بعض المسائل من جهة الفقه، واستشكلوا أقوالهم فيها، فجاءت هذه الدراسة لتنظر في تلك المسائل المُشْكِلات، وتتبين أسباب أو علل استشكالها، وتعرض طرائق الأئمة المالكية ومسالكهم في الجواب عنها وفق مبحثين اثنين؛ جعلنا الأوّل منهما للتّعريف بالمسائل المشكلات، وبالمصنفات التي اعتنت بتلك المسائل، وبعرض علل استشكال الفقهاء لتلك المسائل، وخصصنا الثّاني منهما لعرض طرائق الأئمة في الجواب عن مشكلات المدوّنة، وأنهينا الدراسة بخاتمة دوّنا فيها أهم النتائج التي خلصنا إليها من وراء الدراسة، وألحقنا بها ما اقترحناه من توصيات. Abstract El Mudawana which was narrated by Sahnoun has contained the sayings of Imam Malik and his companions. Although, it was the first resource in the Malikite doctrine, the Malikite scholars did not accept what they said in some matters from the point of view of jurisprudence, and they considered their statements "problematic sayings" which needed some interpretations and explications. So this study came to look at these problems and their reasons, and the methods of the Malikite imams in answering them according to two topics, we made the first of them to identify the issues of these problems, and the works that took care of those issues, and by presenting the reasons for the question of the jurists to these issues, and we allocated the second of them to present the methods of the imams in answering the Mudawana's problems. We concluded the study with a conclusion in which we wrote down the most important results, and suggested some recommendations.
