الملخص
وصفت الحرب السورية بأكبر مأساة إنسانية، لم يشهدها التاريخ الحديث من قبل، أمام إخفاق جميع مبادرات المجتمع الدولي للتوصل لحل توافقي سياسي، إذ تعكس الأزمة السورية التحديات التي تواجه محاولات التوفيق بين اعتبارات تحقيق العدالة والاعتبارات السياسية، مما يؤثر سلبا على فعالية المحكمة الجنائية الدولية في وضع حدّ للإفلات من العقاب، وممارسة اختصاصها على الأشخاص المسؤولين عن ارتكاب أشدّ الجرائم خطورة . The Syrian war has been described as the greatest human tragedy never witnessed before in modern history due to the failure of all initiatives of the international community to reach a political compromise, the Syrian crisis reflects the challenges facing attempts to reconcile justice and political considerations, which negatively affects the effectiveness of the International Criminal Court in ending impunity, and the exercise of its jurisdiction over the persons responsible for the most serious crimes.
