عقد شراء الكهرباء المنتجة من مصادر الطاقة المتجددة في التشريع الجزائري

الملخص
عقد شراء الكهرباء يمثل الإطار القانوني الوحيد من أجل تسويق الكهرباء المنتجة من استغلال الطاقات المتجددة، ويخضع هذا العقد للأحكام العامة للعقود، بالإضافة إلى أحكام خاصة تميزه وتجعله عقدا يحظى بنظام قانوني خاص، سواء في إبرامه أو تنفيذه يبرم عقد شراء الكهرباء بين المنتج الذي يخضع لقواعد إدارية صارمة أهمها الحصول على رخصة استغلال منشاة الإنتاج وشهادة ضمان أصل الطاقة، والذي يلتزم بنقل ملكية الكهرباء المنتجة للمشتري الذي يمثله مسير منظومة توزيع الكهرباء، مقابل ثمن يحدد وفق تسعيرة مضمونة للشراء، فيما يتم تغطية باقي تكاليف الإنتاج عن طريق صندوق تمويل الطاقات المتجددة. عقد شراء الكهرباء عقد ذو طبيعة إدارية يمتد لمدة محددة قانونا، يتميز بنظام خاص في إمكانية تعديله وأسباب إنهائه، كما يخضع لرقابة بجنة ضبط الكهرباء والغاز ووزير الطاقة، وفقا للأحكام القانونية والتنظيمية المتعلقة بمرفق الكهرباء. The agreement of purchase of electricity represents the only legal framework for the marketing of electricity produced from the exploitation of renewable energies. This agreement is subject to the general provisions of contracts, in addition to special provisions that distinguish it and make it a contract with a special legal system, either in its conclusion or implementation. The electricity purchase agreement is concluded between the producer who is subject to strict administrative rules mainly the obtaining of a license to exploit the production; he is committed to transfer the ownership of electricity produced to the buyer represented by the officer of the electricity distribution system, for a price determined according to guaranteed pricing for purchase, while the rest of the costs of production is covered through the Fund for renewable energies. The purchase agreement is an contract that extends for a specified period of time. It is characterized by a special system in the possibility of amendment and reasons for its termination. It is also subject to the supervision of the Electricity and Gas Control Committee and the Minister of Energy in accordance with the legal and regulatory provisions related to the electricity facility.
