دور ضمانة تحويل رأسمال في جلب الاستثمار الأجنبي

الملخص
يعتبر الاستثمار الأجنبي مفتح التنمية الاقتصادية، لذا تعمد مختلف الدول منها الجزائر إلى استقطابه من خلال توفير الحماية اللازمة لذلك. ومسايرتا لمختلف المستجدات ومحاولتا لجلب رؤوس الأموال الأجنبية سنت الحكومة الجزائرية ترسانة قانونية لمنح الضمانات والمزايا الضرورية، والانضمام إلى العديد من الاتفاقيات لتطوير وترقية الاستثمار. رغم وجود المبدأ المتعارف عليه والمتمثل في التزام الدول المستوردة للاستثمارات بضمان معاملة المستثمر الأجنبي وأمواله بشكل يتفق و الحد الأدنى لمعاملة الأجانب، يبقى متخوفا من استثمار أمواله وبحاجة إلى ضمانات وحوافز أكثر نجاعة لذا قام المشرع الجزائري بإيجاد حوافز توفي بالغرض ولعل أهمها حرية تحويل رؤوس الأموال، يعتبر الحق في التحويل من بين أهم الضمانات التي تمنحها الدولة المضيفة للمستثمر الأجنبي ويعتبره البعض شرطا أساسيا لجلب رؤوس الأموال الأجنبية، لذا كان من المتفق عليه أن أحسن حماية في هذا المجال هو ضمانة تحويل دون شروط، ولكن في بعض الحالات تفرض الدولة المضيفة بعض الشروط على ممارسة هذا الحق. لذا فإن مبدأ حرية التحويل يخضع لمجموعة من القواعد وتحتفظ الدولة بحق الرقابة على الصرف وحركة رؤوس الأموال. Abstract Foreign investment is considered key to economic development for different coun, including Alger to polarization by providing the necessary protection, and for that keeping pace with various development and trying to bring foreign capital, The Algerian government enacted a legal arsenal to grant necessary guarantees and privileges to protect them from all risks and join many agreements for the development and promotion of investment. Despite the existence of the accepted principle of the obligation importing countries to invest in ensuring the treatment of the foreign investor and the minimum treatment is agreed, remains fearful of investing its funds and in need of more effectives safeguards and incentives so the Algerian legislator found incentives that died for the purpose, perhaps the most important freedom of transfer of capital, the right to transfer is among the most important guarantees granted by the host countries to the foreign investor and is considered by some as a prerequisite for bringing in the capital, so it was agreed that the best protection in this area is to ensure the conversion without any condition. Therefore, the principle of transfer is subject to a set of rules and the state reserves the right to control the exchange and movement of capital.
