الملخص
الملخص إن حتمية شراكة الأمن بين العام والخاص في ظل تطور وظيفة الدولة تظهر في فقدان احتكارية الأمن من طرف الدولة بسبب تحولات القانون العام بتحول مفهوم ومضمون الأمن، الزوال الفقهي والإيديولوجي للسلطة العامة ليحل محله مفهوم تقني. بالإضافة إلى تحول مفهوم النظام العام الذي يعتبر مفهوم مرن يواكب مختلف المتغيرات والذي أثر بدوره على الضبط الإداري. ويعتبر تحقيق الأمن كامتداد للحريات. نتج عن كل ذلك بروز الأمن الخاص كعنصر مساعد ومكمل للأمن العام. و لقد عرفت الجزائر ظهور شركات الحراسة في التسعينات نتيجة ظروف أمنية خاصة كانت خلالها الدولة عاجزة عن تحقيق الأمن. أما من الناحية الاقتصادية ففي إطار دخول الجزائر إلى اقتصاد السوق وتكريس الحريات تطبيقا لأحد أهم المبادئ الدستورية وهي مبدأ حرية الاستثمار والتجارة المنصوص عليه في المادة 43 من الدستور بعد تعديل 2016 (حرية التجارة والصناعة في المادة 37 من دستور 1996) وفي إطار القانون الجزائري للاستثمارات الساري المفعول تم فتح سوق الأمن في الجزائر. Abstract The inevitability of the public-private security partnership in light of the development of the state's function shows the loss of monopolization of security due to changes in public law. This being due to the transformation of the concept and content of security, but also to the conceptual and ideological demise of the public authority, which are replaced by a technical conception. In addition to the transformation of the concept of public system, which is a flexible concept that keeps pace with the various variables, which in turn affected the administrative control. Security is seen as an extension of freedoms. This has resulted in the emergence of private security as an adjunct and complement to public security. Algeria became aware of the emergence of security companies in the 1990s as a result of special security conditions during which the state was unable to achieve security. In the context of Algeria's entry into the market economy and the establishment of freedoms in accordance with one of the most important constitutional principles, the principle of freedom of investment and trade provided for in article 43 of the Constitution after the amendment of 2016 (Freedom of trade and industry in article 37 of the 1996 Constitution) and under the Algerian law of investments in force, the security . market in Algeria was opened
