المقاطعة الإدارية كهيئة غير ممركزة جديدة في الجزائر The New Deconcentrated Administration District In Algeria

الملخص
يتناول هذا المقال دراسة النصوص القانونية المتعلقة بعملية التنظيم الإداري الجديدة والتي شملت مجموعة من الولايات الجنوبية سنة 2015، حينها قررت السلطات العمومية في مجلس وزاري مصغّر استبدال بعض الدوائر بهيئات جديدة تدعى بالمقاطعات الإدارية، وبعد مرور ثلاث سنوات امتدت هذه العملية إلى جزء من الولايات الشمالية. إنّ المقاطعة الإدارية تتمايز عن هيئة الدائرة من حيث الهيكلة والصلاحيات الهامة التي تتمتع بها بقصد بعث التنمية المحلية في تلك المناطق إضافة إلى ضمان خدمة عمومية ملائمة لمواطنيها، في انتظار أن تتحول هذه المقاطعات إلى ولايات مستقبلا. وما يثير الانتباه هو تغاضي هذه السلطات وعلى رأسها وزارة الداخلية والجماعات الإقليمية عن الوضعية التي آلت إليها هيئة الدائرة مع مرور السنوات، حيث أضحت دون نظام قانوني واضح منذ ظهورها الأوّل في قانون الولاية لسنة 1969 ضمن الأحكام الانتقالية. الكلمات المفتاحية: المقاطعة الإدارية، الدائرة، الدائرة الإدارية، الوالي المنتدب، مجلس المقاطعة، التنظيم الإداري، عدم التركيز الإداري، الولايات الجنوبية، ولاية الجزائر. Abstract: Abstract: This article analyzes the legal texts related to the new process of administrative organization concerning part of the wilayas located in the South and the North of the country, at the beginning of 2015 and three years later. In 2015 the public authorities decided, through a mini ministerial council, to replace the Daïras with new institutions called administrative districts. These are distinguished from the structure of Daïra in terms of structure and the important powers it has, and this to promote local development in these remote areas and provide an adequate public service to its citizens, pending the transformation of these constituencies in future Wilayas. Referring to the importance of this new deconcentrated structure, we underlined the immobility of the Ministry of the Interior and local authorities, towards the uncertain legal status of the Daira over the years, and this since its first appearance in the law of the Wilaya dated in 1969 the transitional provisions.
