الملخص
يهدف هذا المقال الى تسليط الضوء على المنظومة القانونية الجزائرية الخاصة بمواجهة ظاهرة الهجرة غير النظامية الوافدة الى الجزائر، من خلال تبيان وتحليل المقاربة التشريعية الراهنة لمكافحة الهجرة غير النظامية ومدى فعاليتها في مواجهة تزايد تدفق المهاجرين على الحدود الوطنية والعوائق التي تواجهها الى يومنا هذا وسبل وآفاق حلها. ذلك أن الواقع الذي فرضته الظروف الدولية ساهم في زيادة عدد المهاجرين نحو الجزائر كبلد وجهة أو كبلد عبور، مما حتم على المشرع الجزائري التحول من نمط بناء منظومة قانونية تجابه الهجرة من الجزائر الى خارجها، الى توجه جديد هدفه مواجهة حركات الهجرة القادمة الى الجزائر من الدول الحدودية كمالي او النيجر أو من حتى من دول العمق الافريقي، واعتماد سياسة أمنية تتبنى تدابير ادارية وقسرية هدفها الحد والتصدي للتداعيات الخطيرة للهجرة غير النظامية على الأمن والنظام العام في الجزائر. حيث يتجلى لنا في هذه الدراسة مقدار القصور الذي تعانيه القوانين الجزائرية ذات الصلة بموضوع الهجرة، لاسيما ما يتعلق بغياب تحديد مفهوم الهجرة غير النظامية الوافدة، وتجريم الافعال التي تعد من قبيلها. و كذا انعدام الآليات الاتفاقية مع دول الجوار لمكافحة الهجرة غير النظامية إلى الجزائر. Abstract: This article aims to shed light on the Algerian legal system to confront the phenomenon of irregular migration to Algeria, by analating the current legislative approach to fight against irregular migration and its effectiveness in the face of the increasing flow of migrants at the national borders and the obstacles faced to this day and ways and prospects to resolve. The reality imposed by international circumstances has contributed to the increase in the number of migrants to Algeria as a destination or transit country, which necessitated the Algerian legislator to shift from the pattern of building a legal system to face migration from Algeria to abroad, to a new orientation aimed at countering immigration movements coming to Algeria from neighboring countries as Mali and Niger and even from the depth of Africa .By adopting a security policy that adopts administrative and coercive measures aimed at reducing and addressing the serious repercussions of irregular migration on security and public order in Algeria. This study, show us that the Algerian laws which are destined to the subject of migration are Inappropriate and limited especially with regard to the absence of defining the concept of irregular immigration and criminalizing acts that are considered such. As well as the lack of mechanisms agreement with neighboring countries to combat irregular migration to Algeria
