الكفاءة في الزواج ودور العرف في التوسعة من مجالاتها

الملخص
شرع المولى تبارك وتعالى الزواج للحفاظ على النسل البشري وجعل له ضوابطاً وشروطاً لا بد أن تتوافر فيه لتضمن استمراريته وديمومته، من ذلك الكفاءة في الزواج ودورها في الحفاظ على الروابط الأسرية، وما للعرف من دور بالغ في التوسعة من مجالاتها، فبالإضافة إلى شرط التدين والخلق يجب مراعاة صفات اقتضت الظروف الزمانية والمكانية الالتفات إليها منها النسب والصنعة و السِّنُّ والتحصيل العلمي والجمال وغيرها، حتى يتحقق المقصود من تشريع الزواج وهو الألفة والمودة والسكينة التي تسود الآسرة المسلمة. In addition to the requirement of religious and creation, consideration must be given to the characteristics of temporal and spatial circumstances, including birth, age, educational attainment, beauty, etc., in order to achieve the purpose of the marriage legislation, namely, the intimacy, the intimacy and the tranquillity of Muslim families.
