تعلق الحرام بذمتين في المعاوضات المالية دراسة تأصيلية تطبيقية

الملخص
الملخص: موضوع هذا البحث يتعلق بمسألة تعلق الحرام بأكثر من ذمة، فالحرام قد يتعلق بذمة مرتكبه الأول المباشر كمن يعامل بالربا أو السرقة، وقد يتعلق بذمة شخص آخر وهو من يتعامل مع من ماله حرام، أو يشتري سلعة مسروقة أو يؤجر محله لمن يستغله في الحرام، فيكون آثما كذلك لأنه من التعاون على الإثم والعدوان ومن الركون إلى الذين ظلموا. فالهدف من هذا البحث هو تجلية الغموض عن هذا الموضوع. ومما توصلت إليه أن "الحرام يتعلق بذمتين" كما عليه جمهور العلماء، وأن قاعدة" الحرام لا يتعلق بذمتين" كما يقول الحنفية ليست على إطلاقها. وقد تحدثت في المبحث الأول: عن تعريف الذمة والحرام وبينت أنواع الحرام، وفي الثاني: بينت حقيقة تعلق الحرام بذمتين وضوابطها، ومذاهب العلماء فيها، وفي الثالث: تعرضت لتطبيقات تعلق الحرام بذمتين وعدم تعلقه في العاملات المالية، واقتصرت على البيع والشراء للسلع المسروقة وكذلك الكراء والتأجير لمن يستغل ذلك في الحرام وعلى التعامل مع من ماله حرام، وختمته بنتائج وتوصيات Abstract The subject of this research is related to the issue of haraam attachment to more than one thing.
