دسترة الحقوق السياسية للمعارضة- اتجاه نحو تعزيز مبدأ الفصل بين السلطات-

الملخص
يعتبر مبدأ الفصل بين السلطات أحد أهم أسس الأنظمة الديمقراطية، وأهم المبادئ الدستورية، فهو يهدف إلى أنظمة سياسية تضمن الحقوق والحريات الفردية والجماعية، إلاَّ أن تطبيقه في الأنظمة المختلطة وفق صورته التقليدية، أصبح يثير إشكالات متعددة، خاصة مع بروز ظاهر الأغلبية البرلمانية، مما أدى إلى ظهور اتجاه جديد يهدف لتعزيز تجسيد المبدأ على أرض الواقع من خلال الفصل بين الأغلبية والمعارضة. هذا الاتجاه تبنته الجزائر من خلال الإصلاحات الدستورية التي أقرتها في التعديل الدستوري لسنة 2016والتي بموجبها منحت للمعارضة حقوقا سياسية تمكنها من أن تلعب دوراً بارزا، وتساهم في تفعيل الدور الرقابي للبرلمان، لذلك سنتناول دوافع دسترة الحقوق السياسية للمعارضة، ولوسائل تدخل المعارضة لتفعيل دور البرلمان تكريساً للاتجاه الجديد. الكلمات المفاتيح : الحقوق السياسية، المعارضة، الفصل بين السلطات، الأغلبية البرلمانية، الرقابة البرلمانية. Résumé Le principe de séparation des pouvoirs et considérée comme l'une des base des systèmes démocratiques, toutefois, son application dans les systèmes mixte selon la version traditionnelle pose beaucoup de problèmes surtout avec l'apparition de la majorité parlementaire, ceci engendré l'apparition d'une nouvelle tendance visant la consolidation d'un principe sur le terrain à travers la séparation entre la majorité et l'opposition. Ce choix a été suivie par l'Algérie a travers les réformes constitutionnelle de l'année 2016 en donnant a l'opposition des droits politiques qui lui permettent de jouer un rôle de contrôle parlementaire. Pour cela, nous allons évoquer les motivations constituantes des droits politiques de l'opposition, ainsi que les moyens de sons intervention pour activer le rôle du parlement en concrétisant la nouvelle tendance Abstract The principle of powers separation is one of the most important democratic systems. However, its implementation in mixed regimes according to classical approach has made many problems notably with the emergence of parliamentary majority. ; that led to the appearance of a new trend aiming to boosting the principle in reality through the separation between majority and opposition. Such a tendency was adopted by Algeria through constitutional reforms set by 2016 constitutional amendment under which the opposition was given political rights that enables it to play an outstanding role and thus to contribute in too operationalizing the parliament control role. Henceforth, we‘ll shed light on the reasons of introducing opposition political rights and its intervention means in order to strengthen the new trend.
