الطلاق كتابة عبر البريد الالكتروني

الملخص
تهدف هذه الدراسة إلى البحث في نازلة من النوازل المستجدة التي تفرضها تحديات الثورة التكنولوجية بوسائلها المختلفة خاصة فيما يتعلق بحلّ عقد الزواج بواسطة الطلاق عبر البريد الالكتروني،الذي يتطلب توافر شروط لوقوعه كتابة برسالة نصية. كما طرح هذا المستجد اختلاف بين الفقهاء في وقوعه كتابة عبر الايميل من عدمه بين مؤيد ومعارض،أما الموقف القانوني بالنسبة للتشريع الأسري الجزائري فقد شهد فراغا فيما يخص هذا المستجد المفروض بفعل ما يعيشه العالم من تطور ملحوظ ومشهود في عالم الوسائط الالكترونية على عكس بعض التشريعات الوضعية مثل التشريع الماليزي والأردني التي عالجت النازلة، لذا كان لزاما استدراك ماهو حاصل بإضافة مواد قانونية تعالج وقوع الطلاق بهذه الطريقة لمواكبة التقدم التكنولوجي الحاصل. This study aims to look at the coming-of-the-new situations posed by the challenges of the technological revolution by its various means, especially with regard to the dissolution of the marriage contract by e-mail divorce, which requires the availability of conditions for its occurrence in writing by text message. This new development also presented a difference between the jurists in the fact that it occurred in writing or not between supporters and opponents, but the legal position with regard to algerian family legislation has witnessed a vacuum with regard to this new situation imposed by the world's remarkable and remarkable development in the world of electronic media, unlike some In-house legislation such as Malaysian and Jordanian legislation that dealt with the descent, so it was necessary to address the issue by adding legal articles that address the occurrence of divorce in this way to keep pace with technological advances.
