النّظام القانوني للهيئة الوطنية لحماية وترقية الطفولة في التشريع الجزائري

الملخص
لا شك أن الطّفل يعتبر أضعف حلقة في سلسلة الأسرة والمجتمع، لذلك نجده سهل التّعرّض لانتهاك حقوقه المادية والمعنوية وعدم استيفائها كاملة. وفي ظل هذا الوضع تحرّك المجتمع الدولي رافضا أي مساس بحقوقه، من خلال الإعلانات والبروتوكولات والاتفاقيات والوثائق الدولية العامة والخاصة، التي شكّلت بكاملها مصدرا تشريعيا دوليا لحماية حقوقه وطنيا. وفي هذا الإطار التزم المشرع الجزائري بالتّشريع الدولي واستجاب له، بالمصادقة عليه، ولم يكتف بذاك، بل قام بإصدار تشريع وطني خاص بالطفل يحميه من المخاطر المُحدقة به، ويضمن استيفاؤه إياها. فبعد تجربة دامت أكثر من أربعين (40) سنة من إصدار وسريان أول قانون خاص بحماية الطفولة والمراهقة بموجب الأمر رقم 72/03، هاهو يلغي هذا الأخير ويُصدر قانونا جديدا رقم 15/12 يتعلق بحماية الطفل، ويتبعه بتنظيم لاحق له رقم: 16/334، وعليه نقترح هذه الورقة البحثية لدراسة النظام القانوني الجزائري للهيئة الوطنية لحماية الطفولة وترقيته، كأحد الآليات المكرّسة لحماية الأطفال في خطر اجتماعيا. Abstract : There is no doubt that the child is the weakest link in the family and community chain, so we find it easy to be exposed to the violation of his material and moral rights and not to fully satisfy them. In this situation, the international community has moved to reject any violation of its rights through international declarations, protocols, conventions and documents, which have constituted an international legislative source for the protection of its rights nationally. In this context, the Algerian legislator has adhered to and ratified international legislation by ratifying it, not only by enacting national legislation on children that protects it from the dangers it faces, and guarantees its fulfillment. After more than 40 years of experience in the enactment and entry into force of the First Law on the Protection of Children and Adolescents under Order No. 72/03, the latter repeals and promulgates a new law No. 15/12 on the protection of children, followed by subsequent organization No. 16/334 Therefore, we propose this research paper to study the Algerian legal system of the National Authority for the Protection and Promotion of Children, as one of the mechanisms devoted to the protection of children at social risk.
