مبدأ حياد الإدارة الانتخابية وتأثيره على النظام الديمقراطي The Principle Of Neutrality Of The Electoral Administration And Its Impact On The Democratic System

الملخص

تتناول هذه الورقة البحثية مبدأ حياد الادارة في محاولة لفهم أسسه وأبعاده وإستيعاب تأثيراته على النظام الديمقراطي بهدف تسهيل عملية تطبيقه على أرض الواقع، وتنطلق الدراسة من فرضية أن النصوص المكرسة لهذا المبدأ غير كافية لوحدها لضمان تطبيقه وحمايته خاصة في الأنظمة التي تكرسه بناء على إلتزاماتها الدولية أو تقليدا لما وصلت إليه الأنظمة الديمقراطية الغربية العريقة، هذا التكريس الفوقي يخلق صعوبة في التطبيق لإنفصاله عن الواقع، وهو ما يتطلب إرادة مجتمعية وسياسية واعية بأهميته في البناء الديمقراطي وتأثيره على الاستقرار السياسي والتوجهات العامة للناخب. This research investigates the principle of neutrality of the administration in an attempt to understand its foundations, dimensions and to realize its influences on the democratic system so as to facilitate the process of its application on the ground. The current study originates from the hypothesis that the provisions devoted to this principle, are insufficient to ensure its application and protection, especially in regimes which are based on their international obligations or imitating the long-established Western democracies. As a tradition of the old Western democracies, this overarching devotion creates difficulty in implementing its separation from reality. This involves societal and political will, conscious of its importance in democratic construction and its impact on political stability and voter attitudes.
