الملخص

ملخص حظيت الانتخابات الرئاسية والبرلمانية باهتمام خاص من قبل المشرع الجزائري، حيث خصها بمنظومة تشريعية تشمل جميع مراحل العملية الانتخابية منذ بدايتها إلى نهايتها، وذلك لما تلعبه هذه الانتخابات من دور بارز في إرساء نظام سياسي يقوم على أسس ديمقراطية حقيقية. ولضمان تجسيد ذلك ميدانيا أقر المشرع الجزائري عدة آليات رقابية مختلفة على هذه الانتخابات تبدأ من مرحلة استدعاء الهيئة الناخبة إلى غاية إعلان النتائج الأولية، بشكل يضفي الطابع الديمقراطي عليها ويضمن نزاهة وشفافية العملية الانتخابية. وعلى الرغم من الخطوة الجريئة والإيجابية التي أقدم عليها المشرع الجزائري في هذا المجال إلا أن هذه الرقابة تبقى غير كافية لتجسيد المفهوم الحقيقي للديمقراطية وضمان نزاهة وشفافية العملية الانتخابية نظرا لما يشوبها من نقائص تستدعي تدخل تشريعي لتداركها . Abstarct : The presidential and parliamentary elections received special attention by the Algerian legislator, as he singled them out with a legislative system that includes all stages of the electoral process from its inception to the end, because of the prominent role these elections play in establishing a political system based on real democratic foundations, and to ensure that this is embodied in the field the Algerian legislator approved Several different oversight mechanisms for these elections start from the stage of recalling the electorate to the purpose of announcing the initial results, in a manner that democratizes them and ensures the integrity and transparency of the electoral process.
