الهجرة غير الشرعية في المتوسط: دراسة في المفهوم

الملخص
ملخص: أصبحت ظاهرة الهجرة غير الشرعيّة من أهم الظواهر التي حظيت باهتمام دولي ملحوظ في السنوات الأخيرة، إنّ مساوئها انعكست سلبا على سائر دول العالم التي تضرّرت اجتماعيّا واقتصاديا وسياسيّا وثقافيّا، وأمنيّا، وللحدّ منها كان على الحكومات أن تنظر في الأسباب التي أدّت إليها، كالحروب، الفقر، اللامساواه، اللاعدالة، البطالة، الكوارث الطبيعيّة والاضطرابات السيّاسيّة الداخلية التي ينشأ عنها نزوح الأشخاص فرادى وجماعات إلى مناطق أخر من الوطن، وقد تقوم الدولة نفسها بالتهجير القسري للسكان الذي ليس للأشخاص فيه حرّيّة، في حين يتسلّل آخرون إلى دول أخرى طلبا للجوء بحثا عن العيش الكريم. وفي إطار الشريعة... إنّ لكلّ إنسان حقّ اللجوء في حالة تعرّضه للاضطهاد، وعلى البلد الذي لجأ إليه أن يجيره حتّى يبلغ مأمنه، ما لم يكن سبب لجوئه اقتراف جريمة.
