البطانة وأثرها في تصرفات الحاكم والمحكوم في فقه السياسة الشرعية

الملخص
ملخص: البطانة في الشرع هم أصحاب الحاكم، المستشارون في أمور حكمه، المنفذون لأوامره، المطلعون على أحوال محكوميه. وهي نوعان: بطانة صالحة، وبطانة سيئة، وينقسمون بحسب تركيب الدولة المعاصرة إلى السلطات الثلاث: التشريعية، التنفيذية والقضائية. ولكل نوع منها أوصاف؛ فالبطانة الصالحة هي بطانة كاملة العقل كثيرة التجربة، متدينة، ذكية، عالمة بمقتضيات كل عصر وحوادثه… أما البطانة السيئة فمن أوصافها: الغش والخيانة، والتحايل، والنفاق، والبغضاء لأهل الصلاح... ولهذا فقد حث الشارع على انتقاء البطانة الصالحة، ونهى عن اتخاذ البطانة السيئة، ودعا إلى إبعادها عن كل ما فيه مصالح المسلمين. This research speaks about the servants in the divine law, who are the friends of the ruler, the admonishers in the main affairs of his rule, they are working according to their orders and awaring of his citizens . They are two kinds : the honest and bitter servants, and devided ,according to shape of the contemporary nations, into three authorities :legislative, excutive and judicial one. Each of the two servants has many characteristics ; the honest ones are the servants those have a good assimilation ,good experiences , have strong religious beliefs, intellegents, knowing more about every epoch and its facts and events… but the bitter servants are those who have the deception and betrayal, misleading, flattery, hating the devoted men… Therfore, the divine law has ordered the rulers to choose the honest servants, and it has prevented them to choose the bitter ones, and must make them far from muslims affairs and benefits
