طرق إبرام الصفقات العمومية في ظل المرسوم الرئاسي رقم 15-247

الملخص

الملخص: إن المشرع الجزائري أعطى أهمية قصوى للصفقات العمومية لأنها وسيلة من الوسائل التي تجسد فكرة استمرار المؤسسات العمومية وهي تخضع لطرق إبرام خاصة. ولقد جاء المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام بصيغة مخالفة للنصوص السابقة لاسيما منها مرحلة الإبرام، بدءا بتحديد شروط وطرق الإبرام وصولا بضبط الآليات الكفيلة بتجسيد تلك الجهود الرامية إلى محاربة الفساد وحماية المال العام. Résumé: Le législateur algérien a accordé une plus grande importance aux marchés publics, étant un des moyens incarnant l’idée de continuité des éta-blissements publics et, par conséquent, ils sont soumis à des conditions de passation particulières. A cette fin, le décret présidentiel n°15-247 portant organisation des marchés publics et délégation des services publics prévoit, contrairement aux textes antérieurs, les différentes phases imposées aux contractants d’une manière explicite, en particulier au stade de conclusion, en commençant par la détermination des conditions et des modalités de la conclusion jusqu’à la régulation des mécanismes permettant de concrétiser les efforts de lutte contre la corruption et de protection des biens publics. Abstracts: The Algerian legislator has given greater impor-tance to public transactions, being one of the means embodying the idea of continuity of public institutions and, consequently, they are subject to special conditions of award. To this end, Presiden-tial Decree No. 15-247 on the organization of pu-blic procurement and the delegation of public ser-vices provides, contrary to earlier texts, for the different phases imposed on contractors in an ex-plicit manner, in particular at the conclusion stage, starting with the determination of the conditions and modalities of the conclusion until the regulation of the mechanisms to concretize the efforts to fight corruption and protect public property.
