الملخص
ملخص: منح المشرع في قانوني البلدية والولاية للجماعات الإقليمية مجموعة من الصلاحيات الرامية إلى بعث التنمية والمساهمة في بناء الاقتصاد الوطني، وفي نفس الوقت وضع تحت تصرفها آلية التعاقد عن طريق الصفقة العمومية لتحقيق ذلك، وتماشيا مع تراجع المداخيل المالية للخزينة العمومية جعل من السلطات العمومية تولي أهمية لهذا الموضوع، من خلال إعادة إصلاح منظومة الصفقات العمومية بإصدار المرسوم الرئاسي رقم 15-247 وتضمينه تدابير تهدف إلى حماية الاقتصاد الوطني وترشيد النفقات، وهي إرادة تتماشى مع تشريع الإدارة المحلية في هذا المجال، فألزم من خلاله جميع المصالح المتعاقدة بضرورة استغلال عقود الصفقات لترقية المنتوج المحلي ودعم المتعاملين الاقتصاديين، كمنح هامش الأفضلية للعروض المتضمنة منتجات وطنية مع منع اللجوء إلى المنتوج المستورد، والسعي إلى تمكين المؤسسات الصغيرة والمتوسطة وبعض فئات المتعاملين الحرفيين من المشاركة في الطلب العمومي. Abstract: In the law relating to the Municipality and the Province, the legislator has granted a set of prerogatives to local authorities to promote local development and contribute to the construction of the national economy. At the same time, he has put the public procurement mechanism at their disposal to enable them to achieve this objective. Moreover, given the decline in the financial revenue of the Treasury, the authorities have given great importance to this subject. They reformed the public procurement system by promulgating the new Presidential Decree No. 15-247, which includes measures to protect national economy and rationalize spending. All in accordance with the legislation of the local administration in this regard. Through this decree, he has encouraged all contracting services to exploit these contracts to develop local products and support economic operators, in particular by introducing preferential margins for domestic products and prohibiting the use of imported product to enable small and medium-sized enterprises and certain categories of craftsmen to participate in public procurement.
