المفاوضات الإلكترونية Electronic Negociation

الملخص
لقد ادى التطور الهائل في مجال الاتصالات الى استخدام الوسائل الالكترونية في ابرام عقود التجارة الدولية واذا كان الاصل في تسوية المنازعات معقود للسلطة القضائية التي هي احدى السلطات الرئيسية في الدولة الا ان هذه الوسائل لا تلائم مقتضيات التجارة الدولية التي تتميز بالسرعة ,لذلك صار من الضروري البحث عن اليات اخرى تكون اكثر فاعلية في حل المنازعات الناشئة عنها , ولعل افضل الوسائل سرعة في تسوية المنازعات هي المفاوضات الالكترونية اذ يتوصل اطراف النزاع الى تسوية ومرضية للطرفين عن طريق المحاورات والمناقشات، والتي تجري بطريقة الكترونية عبر شبكات الاتصال الحديثة والتي تتميز بالسرعة مقارنة بالمفاوضات التقليدية ,يضاف الى ذلك انها لا تحتاج الى التقاء الاطراف المتنازعة وجها لوجه وانما تكون كافة اجراءات المفاوضات الالكترونية عن طريق استخدام الوسائل الحديثة للاتصال. In the field of tremendous development resulted has communications, to the use of this methods in the contracts of international trade, and if the asset in the settlement of disputes knotted the judicial authority which is one of the major powers in the state, however that this means to fit in the requirements of internatinal trade wich is charactrezed by fast, so it became necessary to look for other mechanisms to be more effective in resolving disputes arising from it ,and perhaps the best means speed in the settlment of disputes is negotiations electronic , it reached parties to the conflicts to settle the friendly and muttually satisfactory through debates and discussions, which take placecelectronically via modern communications networks , which are characterized by fast compared the negotiations traditional moreover it to does not need to meet with the disputing parties face to face but all of the procedures negociations electronic throught the use of modern means to communicate.
