المنحى النقدي أسسه وتطبيقاته عند الإمام أبي الحسن اللخمي في كتاب التبصرة -مسائل الأحوال الشخصية نموذجا

الملخص
ترُوم هاته الدّراسة سبْر غوْر أهم الأسُس المنهجية التي طَبعت الطّريقة اللَّخمية في تقْويم النّظر الفقهي المالكي، وتهذيبه وتجديده، وفق منهج استقرائي وصفي للأبْنية الفقهية لمسائل الأحوال الشَّخصية المـُضمَّنة في كتاب التّبصرة، وتحليل فُروعها الفقهية، للخُلوص إلى خارطة أشهر مميزات المقاربة النّقدية للإمام اللَّخمي، ومُكاشفة أهم ثمارها على الإرْث الفقهي في مُستوييْه؛ المحلي بالنّسبة للمدرسة القيْروانية، والجَمْعي بالنّسبة للمذهب المالكي ككُل. -Abstract: The purpose of this study is to explore the methodological foundations that characterized the way of Imam al-Lakhmi in evaluating the jurisprudential view of the Maliki doctrine, and its refinement and renewal, according to an inductive and descriptive approach to the jurisprudential structures of personal status issues included in the book of insight, In order to draw a map of the characteristics of the critical orientation of the Imam Al-Lakhmi, and to expose the fruits of this approach to the jurisprudential heritage at its levels; local for the school of Kairouani, and the collective for the Maliki school . -Résumé: Le but de cette étude est d'explorer les fondements méthodologiques qui ont caractérisé la manière dont l'Imam al-Lakhmi a évalué la vision jurisprudentielle de la doctrine Maliki, ainsi que son affinement et son renouvellement, selon une approche inductive et descriptive des structures jurisprudentielles du statut personnel questions incluses dans le livre de réflexion, Afin de dresser une carte des caractéristiques de l’orientation critique de l’imam Al-Lakhmi et d’exposer les fruits de cette approche du patrimoine jurisprudentiel à son niveau; local pour l'école de Kairouani, et le collectif pour l'école Maliki.
