نماذج من الرّفـق بالحيـوان في بلاد المغرب خلال العصر الوسيط

الملخص
ملخص: من المعروف أن الشريعة الإسلامية سبقت كل القوانين والتشريعات المعاصرة التي نصت على ضرورة الرفق بالحيوان والمحافظة على حقوقه، وتواترت النصوص في القرآن والسنة بذلك، لكن الاشكال ظل قائمًا حول حقيقة تطبيق هذه النصوص على أرض الواقع في المجتمعات الإسلامية عبر مراحل التاريخ المختلفة، فهل تحول الرفق بالحيوان إلى ممارسةٍ عملية؟، أم أنه بقي أمراً نظرياً؟ وستحاول هذه المساهمة أن تُوَّضح كيف اعتنى المسلمون بحقوق الحيوان، كما تتعرض إلى بعض مظاهر الرفق به ببلاد المغرب في العصر الوسيط، حيث تعتمد على الإشارات القليلة التي جاءت مبعثرةً في المصادر، وخاصةً في كتب الفقه والفلاحة، وهي تبين الممارسات التي كان سكان بلاد المغرب يقومون بها من أجل المحافظة على حقوق الحيوان. . : It is well known that Islamic law preceded all contemporary laws and legislations that stipulated the necessity of animal welfare and the preservation of its rights. The texts in the Qur’an and Sunnah were frequent, but the question remains about the fact that these texts are applied on the ground in Islamic societies through different stages of history. Does animal welfare become a practice, or it is still just a theory? This contribution will try to explain how Muslims have taken care of animal rights, as well as some aspects of animal affinity practices in the Maghreb society in the Middle Ages based on the few references that were scattered in the sources, especially in the books of Fiqh and agriculture, which show the practices that Maghreb’s people are doing to preserve the rights of animals.
