التفريق باللعان دراسة تحليلية مقارنة

الملخص
من خلال هذا المقال تطرقنا لواحد من أهم مواضيع الأحوال الشخصية، ويتعلق بصورة من صور فك الرابطة الزوجية باعتباره يرتب أثرا على العلاقة الزوجية من جهة، وله آثار تنصرف إلى النسب من جهة أخرى، وهو موضوع اللعان. واللعان ثابت بالنصوص القرآنية شرعه الله إذا رمى الزوج زوجته بالزنا، ولم يستطع إثباته، أو نفي نسب ولدها منه، بمعنى أنها أتت به من الزنا، أو يقذفها بهما معا، فيرميها بالزنا، وينفي نسب الولد عنه، وتطلب الزوجة إقامة حد القذف عليه، ويطلب هو إقامة حد الزنا عليها وحينئذ يأمر القاضي بالملاعنة. Abstract: Through this article we discussed one of the most important issues of personal status, and related to the image of the dissolution of the marital bond and as it affects the marital relationship on the one hand, and has implications to the descent, which is the subject of tenderness. Al-La'an is consistent with the Koranic texts. Allah has forbidden the husband to commit zina, and he cannot prove it, or deny his son's share of it, in the sense that it resulted in adultery, or throwing it with them. And he is asked to set the limit of adultery on them and then the judge orders the meat.
