الملخص
الملخص: يعتبر موضوع الحماية الجنائية للبيئة من المواضيع المستجدة في النظم القانونية والتي لاقت اهتماما كبيرا من طرف الفقهاء ورجال القانون. لقد سمحت لنا هذه الدراسة من الوقوف على فعالية الحماية الجنائية للبيئة في التشريع الجزائري, سواء من الناحية الموضوعية بالتطرق لمفهوم الجريمة البيئية وتحديد أركانها وتقسيماتها والجزاءات المقررة لمرتكبها, وكذلك من الناحية الإجرائية حيث بينا كيفية معاينة الجرائم البيئية والأشخاص المعهود لهم بذلك وإجراءات المتابعة فيها, مع إيضاح بعض تطبيقات القضايا البيئية أمام القضاء الجزائي. Abstract: The topic of criminal protection of the environment is one the emerging topics in the legal systems that received great attention from jurists and law men. This study has allowed us to stand on the effectiveness of the criminal protection of the environment in Algerian constitution, either from the subjective side by addressing the concept of crime to the environment and Define its elements and subdivisions and the penalties stipulated for the perpetrators, also from the procedurally side we showed how to consult environmental crimes and the individuals entrusted to that and its follow-up actions, with indicating some applications of the environmental cases in the criminal courts
