الملخص
ملخص: تعتبر الملكية العقارية الشائعة من بين أكثر المواضيع المطروحة في أروقة القضاء للفصل فيها ، لاسيما عند عدم التوصل لاتفاق ودي لقسمة العقار المشاع ، مما يجعل أحد الشركاء يلجأ إلى القضاء لرفع دعوى القسمة لتحديد الحصص وإفرازها من طرف القاضي ، ويتم الفصل في الدعوى بحكم قضائي نهائي يقضي بقسمة العقار المشاع ، و يعد هذا الحكم مثبتا للملكية العقارية و يجب شهره ، وهذا بإفراغ محتوى هذا الحكم في عقد رسمي لدى الموثق من أجل إعطاء كل شريك نصيبه مفروزا من العقار المشاع ، و إيداعه لدى المحافظة العقارية للإشهار العقاري ، لكن في بعض الأحيان تثور العديد من الاشكالات حول إيداع هذا النوع من الأحكام القضائية لعدة أسباب حيث تقابل برفض الإيداع أو الشهر من طرف المحافظ العقاري . وعليه فقد حاولنا من خلال هذه الورقة أن ندرس الحكم القضائي المتضمن قسمة العقار المشاع والإشكاليات التي يثيرها عند إيداعه لدى المحافظة العقارية للقيام بعملية شهره. Abstract: Common real estate ownership is one of the most common topics in the judicial framework sought to adjudicate, especially when there is no amicable agreement to divide the common property, which makes one of the partners resort to the judiciary by filing a swearing-in suit to determine quotas and release them by the judge, and the case is decided by a final judicial decision. It is required to divide the common property, and therefore this provision is fixed for real estate ownership must be famous, and this is by emptying the content of this provision in an official contract with the notary in order to give each partner his share of the common property, and deposit it with the real estate province for real estate advertising, but sometimes many revolts For problems about filing this type of judicial decision for a number of reasons, which is met with the rejection of the deposit or the month by the real estate portfolio. Therefore, through this paper, we have tried to examine the judicial ruling that includes the division of real estate and the problems it raises when it is deposited with the real estate province for the monthly process.
