Résumé: L'absence de protection juridique internationale des migrants issus de catastrophes environnementales reflète une forte résistance de la communauté internationale à la création d'une catégorie spécifique de " réfugiés environnementaux ". Ces lacunes contrastent avec le scénario international actuel, où il existe une demande croissante de reconnaissance des droits spécifiques de ce groupe de personnes. Cet article vise à donner un aperçu général de la situation des réfugiés dits environnementaux, des perspectives de la protection juridique internationale et des progrès normatifs qui, bien que rares, n'excluent pas la nécessité d'une protection normative spécifique. La méthodologie était fondée sur les documents et rapports d'organisations internationales et de sites Web spécialisés. Il s'agit d'une analyse qualitative associée à des données documentaires et des références. Bien que le concept de "réfugiés environnementaux" ne soit pas reconnu par les Nations Unies, certains progrès peuvent déjà être constatés tant dans le cadre des organisations intergouvernementales que dans celui de la société civile. D'autre part, la nécessité d'une action internationale efficace, que ce soit par le biais de mesures adaptatives et temporelles, telles que l'utilisation des instruments existants en matière de droits de l'homme, ou par la création d'un statut spécifique et consolidé pour cette nouvelle catégorie de réfugiés est urgente et inévitable.. Abstract: The lack of international legal protection of migrants that come from environmental disasters reflects a strong resistance from the international community to create a specific category of "environmental refugees". These gaps contrast with the current international scenario, where there is a growing demand for recognition of the specific rights of this group of people. This article aims to demonstrate a general overview of the so-called environmental refugees’ conditions, the perspectives of international legal protection, and the normative progress that, although scarce, do not exempt the need for specific normative protection. The methodology was based on the documents and reports of international organizations and specialized websites. It is a qualitative analysis associated with documentary data and references. Although the concept of "environmental refugees" is not recognized by the United Nations, some progress can already be seen both within the framework of Intergovernmental Organizations and of Civil Society. On the other hand, the need for effective international action, be it through adaptive and temporal measures, such as the use of existing human rights instruments, or be it specific and consolidated through the creation of a specific statute for this new category of refugees is urgent and unavoidable.
