الملخص
الملخص: تعتبر الحماية الإجرائيّة للبيئة من بين الموضوعات التي لا تزال محل دراسة وبحث بخصوصها، خاصّة في ظل وجود حماية موضوعيّة للبيئة وصفها البعض بالتخمة في النصوص القانونية، فلا يمكن أن نتصوّر أبداً وجود حماية موضوعيّة للبيئة في ظل عدم وجود حماية إجرائيّة أو قصورها إن وجدت، وذلك لأنّ النصوص الإجرائيّة هي التي تنقل النص الموضوعي من حالة الجمود والسكون إلى حالة الحركة والتطبيق. لهذا كان الاهتمام واجباً من طرف المشرّعين بموضوع الحماية الإجرائيّة للبيئية وإحاطتها بقواعد استثنائية وخاصّة غير تلك الموجودة في قانون الإجراءات الجزائيّة؛ نظراً للطبيعة الخاصّة للجرائم البيئيّة فهي جرائم تمتاز بأنّها ذات طابع تقني وفنّي ويرتكبها أشخاص يملكون تكويناً كبيراً يؤهّلهم للإفلات من العقاب وطمس معالم وأثار جرائمهم، لهذا كان من اللازم أن يتم مواكبة تلك الحركيّة الفنيّة والتقنيّة في الإجرام البيئي بحركيّة إجرائيّة جزائيّة تتناسب مع ذلك. Abstract Procedural protection of the environment is considered among the questions and subjects which remain under consideration, in particular, in the context of objective protection which is of no value to some, it is only an inflation in the legal texts, so, it cannot be imagined that there is objective protection in this total absence of procedural protection, this means that the procedural texts that transfer the objective text from stagnation to movement and implementation. For this reason, the importance was obligatory by legislators regarding the procedural protection of the environment and surrounding it by exceptional rules of environmental crime, the latter is characterized by a technicality, which means that these crimes committed by well-trained people are qualified to escape and cover up the traces and fingerprints of these crimes. So it was necessary to accompany and understand this technical movement in environmental crime with an adequate criminal procedure
