الملخص
الملخص لكل عصر من العصور قضيته التي تفرض نفسها ومن ثم تشغل عقول مفكريه، قضية الحال على المستوى المحلي والدولي هي التلوث البيئي التي تمس الإنسان في كل كيانه حاضره ومستقبله، عليه اعتبرت من أبرز وأخطر قضايا هذا العصر التي يصعب تأجيل الاهتمام بها لما تمثله من تهديد لمقومات الحياة والبشرية بصفة عامة، سواء على مستوى الفرد أو الدولة. مع تحولات الدولة الجزائرية خاصة في الميادين الاقتصادية واعتناق مبادئ اللبرالية ومعه حرية ممارسة النشاط الاقتصادي في الاستثمار والتجارة، أثير معه مشكلات بيئية خطيرة قي الواقع المعاش، على أثرها ظهرت أصوات تنادي بضرورة حماية النظام البيئي والتي اعترف بها الدستور في آخر تعديلاته ضمن الحقوق الأساسية. في إطار فكرة الموازنة بين الحق في ممارسة الأنشطة الاقتصادية على مختلف أنواعها ومراعاة مقتضيات حماية البيئة، من خلال البحث عن تكريس علاقة تكاملية بينهما بعيدا عن التعارض على هذا وجدت آليات قانونية تكفل الأمرين معا للخروج من المشكلة البيئية خاصة منها ذات المصدر الإنساني تحت مسمى حماية النظام العام البيئي. Abstract In each era there is a problem that arises and imposes itself, which pushes scientists to think, the topical subject at the local and global level is environmental pollution that affects the human being in his existence, present and future, this is considered among the most significant and dangerous problems at that time, it requires urgent intervention, because, the latter constitutes a serious threat to life and humanity in general, whether on the individual or the state. With Algeria's state movement, particularly in the economic fields, with the arrival of liberal principles and freedom of economic activity in commercial investment, which has created dangerous environmental problems on the daily scene, there are now calls for ecosystem protection that were taken into account in the latest constitutional reform in terms of main rights. In order to establish a balance between the law of the practice of economic activities with all its diversities, and the consideration of the requirements for ecosystem protection. Then, through the search for a solution that is a complementary relationship between them, legal mechanisms come into play to get out of this environmental problem, especially those of the human being from the perspective of the general ecosystem.
