التطور التاريخي لقوانين حماية البيئة في دولة قطر Historical Development Of Environment Protection Laws In The State Of Qatar

الملخص

تعد دولة قطر من الدول التي اولت قضية البيئة اهتماما كبيرا، ووضعت التشريعات والقوانين التي تكفل الحفاظ على البيئة نظيفة من أي شيء يعكر صفو الحياة او يلوثها، ومن أجل ذلك قامت الدولة بإنشاء المجلس الأعلى للبيئة والمحميات الطبيعية منذ منتصف السبعينيات من القرن الماضي – القرن العشرين. ويقوم المجلس الأعلى للبيئة والمحميات الطبيعية، بوضع السياسات العامة لحماية البيئة وتحقيق التنمية المستدامة، ورسم خطط العمل اللازمة لتنفيذ هذه السياسات، ورقابة الأنشطة والإجراءات والممارسات المتعلقة بحماية البيئة والحياة الفطرية واعداد مشروعات القوانين واللوائح والقرارات والنظم اللازمة لحماية البيئة، وانشاء قواعد معلومات بيئية وطنية وغيرها من الاختصاصات ذات العلاقة بحماية البيئة. وفي عام 2013م أنشأت دولة قطر وزارة خاصة بالبيئة، واستمرت الوزارة حتى عام 2017م حيث تم في هذا التاريخ دمج وزارة البيئة مع وزارة البلدية التي أصبحت تعرف باسم وزارة البلدية والبيئة. وبموجب قانون وزارة البلدية والبيئة، يكون لموظفي المجلس الأعلى للبيئة صفة مأموري الضبط القضائي في اثبات الجرائم التي تقع بالمخالفة لأحكام قانون المجلس واللوائح والقرارات المنفذة له. وينص قانون البيئة بدولة قطر بعدم السماح بدخول المخلفات الخطرة الى البلاد وذلك التزاما ببنود اتفاقية (بازل) التي انضمت لها دولة قطر في 9 أغسطس، 1995م والتي تحظر دفن أية نفايات في بر قطر الا بعد موافقة المجلس الأعلى للبيئة والمحميات الطبيعية في دولة قطر. ونظرا لأهمية الحفاظ على البيئة برا وبحرا لما لذلك من تأثير على حياة الانسان والحيوان والاحياء البحرية، نصت المادة (33) من الدستور القطري، على ما يلي: (تعمل الدولة على حماية البيئة وتوازنها الطبيعي، تحقيقا للتنمية الشاملة والمستدامة لكل الأجيال) ودعت حكومة قطر جميع الهيئات والمؤسسات الرسمية والأهلية والمواطنين والمقيمين الى التعاون مع الحكومة للحفاظ على البيئة من أي شيء يضر بصحة الانسان او الكائنات الحية سواء في البر او البحر، وتقوم الجهات المختصة بفرض غرامات مالية ضد من يخالف قوانين البيئة. وسوف يتضمن البحث الكثير من التفاصيل الخاصة بجهود دولة قطر لحماية البيئة. Abstract: Qatar is one of the countries which pay considerable attention to environment, and thus enacted several legislations and laws to safeguard environment and life from any sort of pollution and harm. In mid-70s of the twentieth-century, State of Qatar established the Supreme Council for Environment and Nature Reserves (SCENR) to set up general policies on environment protection, achieve sustainable development, draft action plans for policies implementation, monitor activities, measures and practices for Qatari environment protection, draft bills, bylaws, resolutions and regulations pertaining to environment protection, establish databases for information on national environment and other procedures relevant to environment protection. In 2013, the Ministry of Environment was established, and then, was merged in 2017 with Ministry of Municipality to form what is called “Ministry of Municipality and Environment (MME).” Pursuant to (MME) Act, civil servants of (SCENR) have the capacity of judicial enforcement officers to prove violations of (SCENR) provisions, bylaws, and resolutions. (SCENR) Act prohibits the transboundary movement of hazardous wastes to State of Qatar, according to Basel Convention (BC) to which Qatar is a signatory since 9th Aug. 1995. (BC) bans burial of hazardous wastes, in any form, in the Qatari lands without SCENR’s prior consent. Given the significance of land and marine environment protection and the consequences of pollution on mankind, animals and marine lives, community, Article (33) of Qatar Constitution stipulates that “the State endeavors to protect the environment and its natural stability, to achieve comprehensive and sustainable development for all generations.” Qatar government has invited authorities, official and private institutions, and citizens and residents to cooperate and contribute to the protection of environment from any threats to human beings health and marine and wild lives. Competent authorities shall impose financial fines against those who violate the environment acts.
