الملخص
عمل المشرع الجزائري على المحافظة على النظام البيئي في قوانين التعمير و البناء على غرار القانون 90/29 المتعلق بالتهيئة و التعمير، و المرسوم التنفيذي رقم 14/27 الذي يحدد الموصفات العمرانية و المعمارية و التقنية المطبقة على البنايات في ولايات الجنوب، و تعتبر مخططات التهيئة و التعمير و مخطط شغل الأراضي من بين الآليات التي وضعت من أجل حماية الوسط البيئي بفرض قواعد ضبطية على كل بناية أو منشآت صناعية يراد إنشاؤها وفرض ضرورة أن تتلاءم مع المعايير البيئية و نبهت النصوص القانونية بضرورة عمل الهيئات الوصية المخولة بتحرير عقود التعمير من رخصة البناء و رخصة التعمير بضرورة التقيد بالشروط الإدارية و التقنية التي فرضتها من أجل ضمان حماية بيئية فعالة. الكلمات المفتاحية: التعمير ، رخصة البناء، البنايات، سلطة، هيئة وصية، مستوى الضجيج. Abstract The Algerian legislator has worked to preserve the environmental system in the laws of construction and construction in the same manner as Law 90/29 on construction and construction, and Executive Decree No. 14/27, which defines the architectural, architectural and technical specifications applicable to buildings in the southern states. Reconstruction and land tenure plan are among the mechanisms that have been set up to protect the environmental environment by imposing control rules on every building or industrial facilities to be established and imposing a necessity to comply with environmental standards. The legal texts have warned of the need for the work of the probate bodies authorized to release construction contracts from the building permit. License For the reconstruction of the need to comply with the administrative and technical conditions imposed in order to ensure effective environmental protection.
