عقد الفرنشايز وآثاره

الملخص
تهدف دراستنا بشكل رئيسي إلى تسليط الضوء على العقود الحديثة ، كعقد الفرنشايز ، الذي تم استخدامه على نطاق واسع في أمريكا ، بسبب نفعه للاقتصاد الأمريكي ، لذلك أردنا في بحثنا إثارة هذا الموضوع ، لأن له أهمية في اقتصادنا الوطني، حيث أن هذا العقد يعتمد بشكل أساسي على نقل المعرفة العملية والتقنية إلى الممنوح له للاستفادة من تجارب المانح الذي يتمتع بشهرة وسمعة في المجال التجاري، في مقابل ذلك فإن المانح له يدفع سعرًا ثابتًا وسعرًا آخر محددًا كنسبة مئوية في العقد ، حيث يتميز عقد الفرنشايز بخصائص عن بقية العقود ، وعند تنفيذه ، فإنه يترتب عنه التزامات مثل الالتزام بنقل المعرفة العملية إلى الممنوح له في مقابل ذلك. يحافظ على سرية المعلومات عند تنفيذ العقد وعند انتهائه. Our study aims mainly to shed light on modern contracts, as the Franchise contract, which was used extensively in America, because of its benefit to the America economy, so we wanted in our research to raise this subject, because has importance in our economy national, as this contract depends mainly on the transfer Practical and technical knowledge to the franchisee to take advantage of the experiences from the franchisor who has fame and reputation in the commercial field in opposite of that, the franchisee paying a fixed price and another price specified as percentage in the contract, as the Franchise contract is distinguished by characteristics from the rest of the contracts, and when execute it, It entails of the obligations such as the obligation to transfer practical knowledge to the franchisee in opposite of that.he should maintain the secret information at executing the contract and when its expiration.
