Résumé: La dignité humaine est un concept juridique bien consacré au niveau des différents textes, à l'échelle internationale et nationale. La présente étude a pour objet le traitement de la notion de la dignité humaine en tant que nouvelle composante de l'ordre public administratif, additionnée à la trilogie classique (la sécurité publique, la salubrité publique et la tranquillité publique), par une reconnaissance jurisprudentielle de la part du Conseil d'Etat français. Ce nouvel élément de l'ordre public affirme l'aspect immatériel de ce dernier, et constitue un fondement des actes de police administrative; ce qui pose des problématiques juridiques concernant les pouvoirs des autorités compétentes. ملخص: تعدّ الكرامة الإنسانية مفهوما قانونيا يحظى بتكريس نصّي واسع، سواء كان على المستوى الدولي، أو الآخر الوطني. تتناول هذه الدراسة الكرامة الإنسانية، ذلك المفهوم القانوني، بوصفها إحدى عناصر النظام العمومي الإداري؛ أضافها مجلس الدولة الفرنسي في اجتهادٍ له؛ إلى الثلاثية التقليدية (الأمن العمومي، الصحة العمومية والسكينة العمومية). هذا العنصر الحديث للنظام العمومي الإداري يكرّس البعد اللاّمادي للمفهوم، ويشكّل أساسا قانونيا يخوّل السلطات المختصة التدخّل واتخاذ تدابير الضبط الإداري؛ الأمر الذي يطرح إشكاليات قانونية بخصوص صلاحيات هته السلطات. Abstract: Human dignity is a well-consecrated legal concept by the various texts, at the international and national levels. The purpose of this article is to study the notion of human dignity as a new element of the administrative public order, added to the classic trilogy (public safety, public health and public tranquility), by the French Council of State. This new component of public order affirms the immaterial aspect of the public order, and constitutes a foundation of administrative police acts; which raises several legal problems about the powers of the competent authorities.
