وسائل الحماية القانونية للحقوق المعنوية للمؤلف في القانون الجزائري

الملخص
تعتبر حقوق المؤلف من أهم حقوق الملكية الفكرية كونها تمثل الابداع الفكري والذهني، وقد احتلت فيها الحقوق المعنوية اهمية قصوى باعتبارها حقوق تحمي المبدع من كل مساس قد يلحق بإبداعه الأدبي، والمشرع الجزائري من جانبه واكب ذلك من خلال سن الأمر 03-05 الذي نظم هاته الحقوق وأقر مجموعة من الاجراءات الوقائية والمسؤولية المدنية عند الاعتداء على هاته الحقوق وأضاف المسؤولية الجنائية كما تبنى المشرع أغلب القواعد المعمول بها في الاتفاقيات الدولية التي تحمي حق المؤلف بصفة عامة، Author's rights are considered one of the most important intellectual property rights because they represent intellectual and mental creativity. Moral rights take a substantial part of them, because they protect the creator from any infringement that could affect his literary novelty. Algerian legislation followed this by creating law 03-05 which regulated these rights and endorsed a certain number of preventive measures and civil liability in case of violation of these rights. It added criminal liability. The law adopted the majority of the rules approved by international conventions which protect the rights of authors in general.
