Protection Sociale De L’enfant En Danger En Matière Pénale: Etude à La Lumière De La Loi 15-12

Résumé: Afin d’assurer une meilleure protection de l’enfance, le législateur algérien a exigé des nouvelles dispositions grâce à la loi n° 15-12 relative à la protection de l’enfant, principalement en matière sociale car l’enfant est considéré comme une personne vulnérable et incapable de se défendre, cette protection trouve sa source dans le droit constitutionnel nonobstant la loi n° 16-01 portant la révision constitutionnelle. Et afin de réaliser cette étude on a adopté une approche analytique. Au terme de cette étude, il faut garantir la sauvegarde de cette catégorie de personnes vulnérables en adoptant des mécanismes juridiques fiables, sachant que le juge des mineurs a le pouvoir discrétionnaire d’apprécier cette situation conformément aux principes de l’égalité en appliquant des mesures procédurales qui permettent de pallier l’incapacité des enfants. Abstract: In order to ensure a better child welfare, the Algerian legislator required a new dispositions thanks to law n° 15-12 relating to the protection of the child, nevertheless on social matters because the child is regarded as a person vulnerable and unable to defend oneself, this protection finds its source in the constitutional law notwithstanding the law n° 16-01 carrying the constitutional revision. And in order to achieve this study I adopted an analytical approach. At the end of this study, it is necessary to guarantee the safeguard of this category of vulnerable people by adopting reliable legal mechanisms reliable legal mechanisms, knowing that the judge of the minors has the discretionary power to appreciate this situation in accordance with the principles of the equality by applying procedural measurements which make it possible to remedy the incapacity of the children.
