الملخص
ملخص: يعتبر صندوق النفقة المستحدث بالقانون رقم 15/01 آلية إحتياطية فعالة للمطلقة الحاضنة وللطفل المحضون، حيث ضمن لهما الحقوق الأساسية وحفظ للمطلقة كرامتها ومنع الطفل من الإنحراف والحرمان، فالذي لم يغفله المشرع هو تحديده الدقيق لحالات الإستفادة من صندوق النفقة،أمّا الذي ربّما تناساه هو أنّه عند تحديده لحالات سقوط الحق في النفقة لم يفرق بين هاته الحالات أهي موجهة للطفل المحضون أم للمطلقة الحاضنة،لهذا كان لابدّ لنا من تبيان هذا الفراغ القانوني من خلال أحكام الشريعة وقرارات المحكمة العليا،وما ننوّه له هو أنّ المشرع قد حرم فئة هامة من الإستفادة من الصندوق وهو أمر قد يسيل كثيرا من الحبر مستقبلا. Summary: The Maintenance fund, established by Act No. 15/01, is an effective acquisition mechanism for the divorced and the child, where the basic rights and the preservation of the dignity of the divorced child are guaranteed and the children are prevented from deviating and deprived, which the legislator has not overlooked is the precise determination of the cases of access to the alimony fund, either Perhaps it is his fault that when he identified the fall of the right to alimony, he did not differentiate between these cases, which is directed at the child of the divorced parent, so we had to demonstrate this legal void through the rulings of Sharia and Supreme Court decisions, and what we note is that the legislator has deprived a significant category of Take advantage of the fund which may be a lot of ink in the future.
