الملخص

هذا المقال محاولة للكشف عن الجهود المضنية التي بدلها الدكتور السباعي في تأصيل حقوق الإنسان في الإسلام في ضوء الكليات الخمس : حفظ الدين أو ما أطلق عليه حق العقيدة، وحفظ النفس أو ما أسماه حق الحياة، وحفظ العقل وهو ما أسماه حق العلم، وحفظ النسل والعرض وهو ما أطلق عليه حق الكرامة الإنسانية، وأخيرا حفظ المال وهو ما أسماه حق العمل، الذي يندرج عنده في تحقيق التكافل الاجتماعي أو ما عرف عنده باشتراكية الإسلام. وكذا في جلب النماذج الشارحة لها، من الفقه الإسلامي وحضارة المسلمين. مع التنبيه إلى ما نثره السباعي في كتبه من تنبيهات وتلميحات مقاصدية جديرة بالاهتمام والإلمام منها: اهتمامه بالتعليل في مجال العقيدة وفي مجال الشريعة عادات ومعاملات وعبادات. واهتمامه البالغ بالاجتهاد في ضوء كليات الشريعة وقواعدها، وهو ما يطلق عليه اليوم الاجتهاد المقاصدي. وغرضه من ذلك كله الكشف عن صلاحية الشريعة لكل زمان ومكان وإنسان. This article is an attempt to uncover the strenuous efforts that Dr. Sibai has made in the consolidation of human rights in Islam in the light of the five faculties: the preservation of religion or what he called the right of belief, and the preservation of the soul or what he called the right to life, and the preservation of reason which he called the right of science, Which he called the right of human dignity, and finally save money, which he called the right to work, which falls within him to achieve social solidarity or what he knew the socialism of Islam.
