الملخص
تعد العقود المنهية لعقود من المواضيع التي لم تُطرح سابقا في الإطار النظري رغم أهميتها، حيث درج الفقه إلى ذكر العقود وتقسيماتها التي ذكرها التشريع شرحا وبيانا، دون أن يحاول إستحداث عقود أخرى تكون صندوقا يلم شتات بعض العقود التي تدخل فيها، ومن هذه التقسيمات المحدثة تقسيم العقود إلى عقود مفضية لإنهاء عقود والتي تُقسم بدورها إلى نوعين عقود منهية لعقود أخرى بشكل مباشر، وعقود منهية لعقود أخرى بشكل غير مباشر، ونحن في بحثنا هذا سنتكلم عن العقود المنهية لعقود أخرى بشقيها المباشر وغير المباشر ملقين الضوء على تطبيقاتها والطبيعة القانونية التي تحكمها والاثار التي تترتب عليها .
