تأمين أضرار الحريق الناجم عن مسؤولية المؤجر ومستأجره

الملخص
تترتب عن العلاقة التعاقدية بين المؤجر ومستأجره في حالة حدوث حريق بفعل أحدهما مسؤولية تعاقدية، بحيث يحق للمضرور منهما الرجوع على الآخر المسؤول بالتعويض وجبر الضرر الحاصل. إلا أنه يجوز للمسؤول منهما عن الحريق، التأمين على مسؤوليته. وعليه، يندرج تحت تأمين مسؤولية المؤجر، ضمان رجوع المستأجر على المؤجر وضمان الحرمان من الانتفاع بسبب الحريق الصادر عن أحد المستأجرين المشاركين في الإيجار. ويدخل تحت تأمين مسؤولية المستأجر، ضمان المسؤولية الايجارية الناجمة عن اِحتراق العين المؤجرة، وضمان حرمان المستأجرين المشاركين مع المستأجر المسؤول في الإيجار من الانتفاع بالعين المؤجرة، وضمان فقدان الإيجار الذي كان يتقضاه المؤجر من المستأجرين المشاركين مع المستأجر المسؤول. La relation contractuelle entre le bailleur et le locataire, en cas d’incendie provoqué par l’un d’eux, inclut une responsabilité contractuelle. Le lésé entre eux a le droit de retourner contre le tiers responsable pour dommage et intérêt. Néanmoins, le responsable de l’incendie entre eux, peut avoir une assurancesur sa responsabilité. Alors, sous l’assurance de responsabilité du Bailleur, intervient la garantie de retour du locataire contre le bailleur et garantir la privation de la jouissance, à cause de l’incendie dû par un des ses colocataires. Sous l’assurance de la responsabilité du locataire, intervient la garantie de la responsabilité locative due à l’incendie de l’immeuble loué, et garantir la privation les colocataires du locataire responsable, de la jouissance de l’immeuble loué, et garantir la perte du loyer que le bailleur recevait des colocataires du locataire responsable The contractual relationship between the lessor and the lessee leads to a contractual responsibility. The damaged one has the right to reclaim from the other responsible indemnity and law damages. Therefore, the responsible of the fire between them can insure his responsibility. So, it is included under the responsibility insurance of the lessor, the guaranty of the reference of the lessor to the lessee,and the guaranty of the lessee privation from enjoyment because of the fire provoked by one of his co-lessees.And under the insurance of the lessor responsibility, towards his lessee, enters the guaranty of the lease responsibility due to burning of the leased real estate, and the guaranty of the enjoyment privation of the leased real estate of the co-lessees with the responsible lessee, and the guaranty of loss the rent that the lessor use to receive from the co-lessees with the responsible lessee.
