فعالية ترقيم العقارات الممسوحة في ضبط الملكية العقارية في التشريع الجزائري

الملخص
ملخص تعتبر عملية ترقيم العقارات الممسوحة من بين الإجراءات القانونية الهامة التي يقوم بها المحافظ العقاري، والتي ينتج عنها في الأخير تسليم الدفتر العقاري لمستحقيه باعتباره سندا إداريا. ويتحدد نوع الترقيم العقاري فيما إذا كان مؤقتا أو نهائيا، بحسب السندات المقدمة من قبل المالك الظاهر الذي يدعي ملكيته للعقار محل المسح. ولقد سمح المشرع الجزائري لكل ذي مصلحة بإمكانية المطالبة بإعادة النظر في الترقيم العقاري، غير أن ذلك لا يتم إلا عن طريق اللجوء إلى القضاء بقطبيه العادي والإداري. الكلمات المفتاحية: المسح العقاري؛ الشهر العقاري؛ الترقيم العقاري؛ الدفتر العقاري؛ المحافظ العقاري. Résumé L'opération d'immatriculation des immeubles cadastrés est l'une des procédures juridiques importantes qui rentre dans les prérogatives du conservateur foncier qui se concrétise par l'obtention d’un livret foncier, qui représente un titre administratif prouvant la propriété d’un immeuble L’immatriculation foncière est soit provisoire ou définitive, selon le titre présenté par le propriétaire prétendant la propriété de l'immeuble objet de l’opération cadastre. Mais il est important de noter qu’il est possible de réclamer la révision de l’immatriculation foncière par voie judiciaires soit devant les instances ordinaires ou administratives. Abstract The operation of numbering cadastre assets is one of the important legal procedures lead by land registers to issue land booklet which is an administrative title. The type of numbering assets is either temporary or permanent depending on the title presented by the apparent owner who owns the land object registry. Algerian legislator gives the right to claim the revision of the land numbering via ordinary administrative courts.
