النظام القانوني للتنازل عن الإيجار - دراسة مقارنة بين القانون المدني الجزائري و قانون الموجبات و العقود اللبناني - The Legal System Of The Lease Assignment Comparative Study Between The Algerian Civil Code And The Lebanese Code Of Obligations And Contracts

الملخص

نص المشرع الجزائري في المادة 505 من القانون المدني على أنه لا يجوز للمستأجر التنازل عن الإيجار إلا بموجب موافقة كتابية من المؤجر، و في المقابل من ذلك، و وفقا للمادة 584 من قانون الموجبات و العقود اللبناني، نص المشرع اللبناني على جواز التنازل عن الإيجار كمبدأ عام، و أنه لا يتم منع أو تقييد حق المستأجر في ذلك إلا بموجب شرط صريح في عقد الإيجار أو بمناسبة منعه من الإيجار من الباطن، و بالتالي تتمثل إشكالية البحث في: إلى أي مدى وفق المشرع الجزائري في تنظيم أحكام التنازل عن الإيجار مقارنة بالتنظيم المنصوص عليه في قانون الموجبات و العقود اللبناني ؟ تتمثل أهمية موضوع الدراسة في أن تنازل المستأجر عن الإيجار يؤدي في العديد من الحالات إلى توتر العلاقة بين الأطراف المعنية بالتنازل، و ذلك لعدم وعي العديد من المستأجرين بأحكام التصرف الذي يقومون به، مما يؤدي عادة إلى وقوع مشاكل قانونية مع المؤجرين. و نظرا لذلك يهدف هذا البحث إلى تحديد أهم الفروقات بين القانون المدني الجزائري و قانون الموجبات و العقود اللبناني فيما يخص تنظيم أحكام التنازل عن الإيجار، و في سبيل ذلك تم اتباع المنهج التحليلي و المنهج المقارن. تم التوصل من خلال البحث إلى أن المشرع الجزائري لم يهتم بتنظيم أحكام التنازل عن الإيجار كما فعل المشرع اللبناني، فالمشرع الجزائري خصص فقط المادتين 505 و 506 من القانون المدني لهذا الموضوع، في حين خصص له المشرع اللبناني المواد من 584 إلى 589 من قانون الموجبات و العقود، لذلك تم الاقتراح من خلال هذه الدراسة أن يخصص المشرع الجزائري مواد أكثر تنظم أحكام موافقة المؤجر الكتابية و آثار التنازل عن الإيجار. Abstract: The Algerian legislator states in the article 505 of the civil code that the lessee may not assign the lease unless he has the written consent of the lessor, on the other hand and according to the article 584 of the Lebanese code of obligations and contracts, the Lebanese legislator states that the lease assignment is allowed in general, and the lessee's right to assign can be prohibited or restricted only by a provision in the lease contract or if he was prohibited from subleasing. Therefore the problematic of the research is: To what extent the Algerian legislator succeeded in regulating the provisions of the lease assignment compared with the regulation provided for in the Lebanese code of obligations and contracts? The Importance of the study is that the lessee's assignment in many cases strains the relationship between the parties concerned to the assignment, because many lessees are unaware of the provisions of their conduct, which usually leads to legal problems with the lessor. So this research aims to identify the most important differences between the Algerian civil code and the Lebanese code of obligations and contracts regarding the regulation of lease assignment provisions, and for that, the analytical comparative approach has been adopted while conducting this study. It was concluded through the research that the Algerian legislator did not care to regulate the provisions of the lease assignment as did the Lebanese legislator, the Algerian legislator allocated only the articles 505 and 506 of the civil code to this subject, while the Lebanese legislator allocated the articles from 584 to 589 of the code of obligations and contracts to it, and therefore, we suggested through this study that the Algerian legislator allocate more articles regulating the provisions of the lessor's written consent and the effects of the lease assignment.
