حماية البيئة البحرية في التشريع الجزائري

الملخص
ملخص البحث: يعد موضوع حماية البيئة البحرية واحد من بين أهم الموضوعات التي ظهرت مؤخرا على الساحة القانونية وذلك راجع لأهمية البيئة البحرية في حد ذاتها، هذه الأخيرة التي أضحت تمثل رقما لايستهان به في اقتصاديات العالم، كونها تمثل مخزونا هائلا للثروات المعدنية وكذا الثروة السمكية، بما في ذلك المياه العذبة بعد عملية التحلية ناهيك عن أهميتها في مجال النقل والإتصال كونها تعد من أفضل الطرق وأيسرها. هذه الأهمية جعلت الدول تسعى جاهدة لإيجاد قواعد قانونية على المستوى الدولي وهو ما تمخض عنه إبرام جملة من الإتفاقيات العالمية الرامية لحماية البيئة البحرية من التلوث على المستوى العالمي، وقد انتهى الأمر بكل تلك الجهود إلى إبرام اتفاقية عامة لحماية البيئة البحرية من جميع مصادر التلوث والمتجسدة في اتفاقية الأمم المتحدة للبحار وقد خصته بالجزء الثاني عشر منها الذي تناول الموضوع بصورة مباشرة. وقد انعكست كل تلك الجهود على المستوى الوطني وهذا بسن المشرع الجزائري لترسانة قانونية (وقائية وردعية) ترمي لحماية البيئة البحرية من الأضرار الناجمة عن التلوث الذي أحدثه الإنسان نتيجة عبثه بتلك البيئة واستغلالها استغلالا سيئا. الكلمات المفتاحية: حماية البيئة البحرية; التلوث البحري; التشريع الجزائري; الإجراءات الوقائية والردعية. Abstract: The protection of the marine environment is one of the most important issues that have emerged recently in the legal arena, due to the importance of the marine environment itself, which has become a significant number in the economies of the world, as it represents a huge stock of mineral wealth as well as fisheries, including Fresh water after desalination, not to mention its importance in the field of transport and communication as it is one of the best and easiest ways. This importance has led States to strive to find legal rules at the international level, which resulted in the conclusion of a number of global conventions aimed at protecting the marine environment from pollution at the global level, and ended all these efforts to conclude a general agreement to protect the marine environment from all sources of pollution embodied in The United Nations Convention on the Sea has been singled out in Part XII, which deals directly with the subject. All these efforts have been reflected at the national level by the enactment by the Algerian legislator of a legal arsenal designed) Preventive and deterrent( to protect the marine environment from damage caused by human pollution caused by its tampering and misuse.
