الوسائل القانونية لحماية البيئة كضابط لحرية الاستثمار

الملخص
تعد الوسائل القانونية لحماية البيئة من أهم المواضيع التي نالت اهتمام الباحثين وبالأخص ما يتعلق بربطه بأحكام قانون الاستثمار، وكذا مبدأ حماية الاستثمار، هذا الأخير الذي أصبح من مجرد فكرة إلى حقيقة قانونية ملموسة لربط البيئة والاستثمار وإدراج أهمية كل منهما للآخر ، إذ أن هدف الدراسة هو الإحاطة بمجمل الوسائل القانونية التي أقرها المشرع الجزائري لإحداث الموازنة بين حماية البيئة من جهة و بين تكريس حرية الاستثمار من ناحية أخرى ، و من أهم النتائج المتوصل إليها هو أن حرية ممارسة الاستثمار تخضع لمجموعة من الضوابط العامة التي أقرتها قوانين مختلفة منها قانون البيئة ، إذ أن مبدأ الحرية مقيد بعدم المساس بالبيئة . The legal means to protect the environment are among the most important topics that have attracted the attention of researchers, especially with regard to linking it with the provisions of the investment law, as well as the principle of investment protection, the latter which has become a mere idea to a concrete legal reality to link the environment and investment and the inclusion of the importance of each other. Taking note of all the legal means approved by the Algerian legislator to strike a balance between protecting the environment on the one hand and enshrining the freedom of investment on the other hand. One of the most important results is that freedom of investment is subject to a set of general controls approved by different laws. The law of the environment, as the principle of freedom is constrained not to affect the environment.
