الحماية الجنائية لنسب الطفل في القانون الجزائري

الملخص
الملخص بالعربية : يحتل الطفل مكانة مهمة في المجتمع لهذا حرصت الشرائع السماوية ومعظم التشريعات الوضعية ومن بينها التشريع الجزائري ، على توفير حماية جنائية واسعة للطفل عن طريق مجموعة من نصوص قانون العقوبات وذلك بتجريم بعض الأفعال التي من شأنها أن تساهم في طمس هوية الطفل وتجريده من نسبه الحقيقي ، ولقد حدد قانون الحالة المدنية في المواد من 61 إلى 69 الأشخاص المكلفين بالتصريح بالمواليد والأوقات المحددة لذلك ، حرصا منه عن مكافحة انتشار ظاهرة اختلاط الأنساب وتزايد عدد الأطفال مجهولي النسب . : Résumé L’enfant occupe une position importante dans la société, c’est pour cette raison que les législations célestes, et la plus part des législations statuaires y compris la législation algérienne prévoyaient une protection pénale étendue de l'enfant par le biais d’un ensemble de dispositions du Code pénal, En criminalisant certains actes qui contribueraient à brouiller l'identité de l'enfant et à lui enlever son vrais descente. Les articles 61 à 69 de la loi sur l'état civil précisaient les personnes chargés de la déclaration de naissance et les dates spécifiées afin de lutter contre la propagation du phénomène de métissage et l’augmentation du nombre des enfants de descendance anonyme. Les mots clés : Enfant – loi - descendance - crime – punition . abstract the child occupies an important position in the society , for this reason the law of heaven and most of the actual legislations ,provide for the broad criminal protection of the child through a set of provisions of the penal code , by criminalizing certain acts that may contribute to the embarrassing of the childs identity and stripping him of his real lineage. the civil status law in arcties 61 to 69 specified the persons responsible for the declaration of birth and the times specifed for this purpose, in order to combat the spread of the phenomenon of mixing of lineages and the increasing number of children of unknown origin .
